Erika Jayne Files Appeal Asking Judge To Remove Lawyer Investigating Her After Previous Request Was Rejected

When threats won’t work, file an appeal just like the rest of us.  Erika Jayne spiraled into a litigation spewing kingpin at Kathy Hilton’s dinner party on the recent Real Housewives of Beverly Hills episode.  Sutton Stracke was an easy target, and Erika seemed in her element acting like a top dog.  Does she still think she has the power she once enjoyed as Mrs. Girardi?  That’s Erika’s life on reality TV among friends, but it doesn’t work in a court of law.  Especially not when hundreds of millions of dollars are allegedly at stake.  A cool $101 million to be exact.  An amount that forced the Girardi Keese Law Firm to file for Chapter 7 bankruptcy.

Erika may want to hiss and snarl at the lawyer investigating Tom Girardi’s bankruptcy case, but she’ll have to resort to filing an appeal instead.  She wants this attorney off her back, and is again asking the courts to remove Ronald Richards from the case after a previous appeal to shut down the motion was denied.

It’s the $25 million lawsuit that Erika would like to do away with.  You know, the one that questions whether she knew that her EJ Global company was being financed by her ex-husband’s law firm?  At least $14 million of that was spent on American Express purchases between 2008 and 2020, according to official documents.  And Erika is being asked to pay it back with interest.

According to Radar Online, Erika’s motion requests the judge to reconsider keeping Richards on the case.  Erika’s admitted to feeling harassed by the lawyer, and suggested he has a conflict of interest being involved.  Richards also represents a company whom the Girardi’s estate is indebted to.

The judge’s response was not sympathetic to Erika.  At the time, he stated, “it appears to be nothing more than a blatant attempt by Ms. Girardi to impede Mr. Richards’ efforts on behalf of the trustee to investigate allegedly fraudulent transfers of the debtor’s assets to Ms. Girardi and to prosecute an action against her to recover those transfers for the benefit of the estate.”

Erika decided to file an appeal and take the issue to higher court.  This motion could delay the investigation against her until a decision regarding Richards is decided.
