Judge Denies Karen Huger’s Plea To Suppress Police Statements and Bodycam Footage of DUI Arrest

Karen Huger’s legal issues are center stage this season on The Real Housewives of Potomac. The Grande Dame isn’t at liberty to speak about the issues on camera. But her castmates are talking enough to compensate for it.

In all seriousness, Karen is at the mercy of the courts and the legal system for the charges rendered for the March incident. Those include driving under the influence and negligently driving a vehicle in a careless and imprudent manner. Also, endangering property, life, and person, among other things.

As the legal process continues, snippets of information are making it to the public. Recently, it was revealed that the RHOP star requested to have police statements and bodycam footage from the DUI excluded from the evidence presented.

Karen Huger claimed she was not read her Miranda Rights

In Touch can exclusively reveal that a Maryland judge denied the motion.

At the time, Karen claimed she was refused further treatment by medical professionals due to the officers on the scene. She also said one of the policemen grabbed her arm to prevent her from leaving once EMTs had assessed her.

Further grievances, according to the Bravolebrity, include illegal interrogation. Karen claimed she was not read her Miranda Rights, though they started questioning her. As a result, her legal team argued that footage and statements from that night should be discarded.

Karen previously requested the entire case be dismissed but was denied.

The prosecutors said, “Officers additionally observed the driver of the vehicle, the defendant, unsteady on her feet, swaying, stumbling, and slurring her speech. Furthermore, the initial caller spoke to officers on scene and indicated that prior to police arrival, the defendant appeared confused and the caller smelled alcohol when interacting with the defendant.”

“[Karen’s] statements were not obtained as a result of a custodial interrogation because some of her statements were made while Emergency Medical Services (EMS) personnel were treating the defendant for potential injuries. [Karen’s] statements made during this time were free and voluntary, and were stated out loud while in the presence of police officers.”

The judge ruled that all footage and statements are “admissable against her at trial”

The judge presiding over the case reviewed the bodycam footage at a recent hearing. He denied Karen’s request.

“The two police separately and persistently asked [Karen] to tell them what happened,” the judge said. “They asked her questions like where she had been. Where she was coming from and how did the accident take place. [Karen] wasn’t forthcoming with her answers. [Karen’s] husband arrived on the scene soon after the police arrived and was by her side until she was arrested.”

“All interrogation took place in the road or roadside. In public with emergency personnel and the emergency vehicle in immediate proximate. The police never used force, impeded [Karen’s] movements, or drew weapons. The interrogation was brief and [Karen] was uncooperative, which was her right. After evaluating the scene and getting only bits and pieces of information from [Karen] and her husband the police arrested her and took her from the scene.”

Karen “was not taken into custody for purposes of Miranda. And consequently, all statements made by [Karen] until the police formally announced that [she] was under arrest and arrested her are admissible against her at trial.”
