Tom Girardi’s legal troubles are catching up to Erika Jayne once again. As many know, Tom has been in the middle of a criminal fraud trial. While several people speculated about Erika’s involvement in the alleged fraud, she ended up mostly off the hook.
Still, Erika did file for divorce from Tom, and since Tom is already in the middle of his criminal trial, the divorce cannot carry on. Meanwhile, Tom also filed for bankruptcy in 2021, so, it’s been a whirlwind for the Girardi/Jayne marriage.
As if all this weren’t enough, The Real Housewives of Beverly Hills star might have to suffer more losses than she initially thought possible. That is, if Tom gets convicted. And as it stands, things aren’t looking great for the former attorney.
How Tom’s conviction after a trial would affect Erika’s wallet
Girardi & Keese’s former special counsel against Erika, Ronald Richards, spoke to The U.S. Sun about what Tom’s potential conviction would mean for Erika. If Tom is convicted, Erika could be looking at a loss of one million dollars, on top of exempt property payouts from the bankruptcy estate.
“Her divorce has been sitting on ice since 2021. They’re doing nothing in that case,” Richards explained. “She is set to get half of whatever remains after the bankruptcy case, some things are exempt and there are community assets. But if he’s convicted, a restitution order could attack whatever is left, and she could lose out, as well as be on the hook for lifetime alimony payments.”
Even though there would theoretically be money left after the bankruptcy case, that’s not taking into account restitution. In criminal cases where an offender is convicted of a crime, they are required to pay restitution fines. Meanwhile, the divorce case has had no new filings since 2021. Richards reported that Erika was “not happy” that Tom was found competent to stand trial.
